What is Substituted Service


Substituted service is a court order that may be sought by a party to serve legal documents on another party through alternative means when the standard method of service is not feasible.

For instance, the standard method of serving a Federal Circuit Court Application for Divorce typically requires personal service, where a process server physically hands the application to the respondent. However, if the applicant attempts to serve the respondent at their last known address and discovers the respondent no longer resides there—and the applicant has no other address for the respondent—the applicant may apply for an order for substituted service. This allows the documents to be served through an alternative method, as personal service is not possible.

In an application for substituted service, you may request alternative methods such as email, post, fax, text message, or even a Facebook message. To succeed in obtaining this order, the applicant must provide the court with strong evidence that the chosen method will effectively bring the documents to the respondent’s attention. For example, providing recent emails or text messages from the respondent can demonstrate that the email address or phone number is currently in use and likely to reach them.

Substituted service ensures that legal proceedings can move forward even when traditional methods of service are impractical, while still upholding the principles of fairness and due process.
